NOTICE OF TRUSTEE'S SALE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 15, 2024, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 4687, at Page 781, Eriq Valenzuela and Mackenzie Arbaugh did convey unto Andrew C. Skinner, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on May 21, 2026, at 5:43 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the St. Albans District, Kanawha County, West Virginia, and more particularly described as follows: Lot 20 the surface, together with any appurtenances thereon, of Lot 20, Block B, Holley Boulevards Addition to the City of St. Albans, Jefferson District, Kanawha County, West Virginia. And being the same Lot described in Deed Book 226, at page 535. And being the same property conveyed to Joseph S. Philpott, Sr., and Harriet L. Philpott, as tenants in common by Lettie Angle, and Josephine Gardner, by deed dated May 4, 1977, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1837, at page 449. Said Joseph S. Philpott, Sr. died intestate on June 18, 1990 in Kanawha County, West Virginia and pursuant to the administration of the estate his interest in and to the subject property descended to Harriet L. Philpott, widow, and his five children, Joseph Stanley Philpott, Jr., Virginia Lynn Philpott, John Oscar Philpott, Jerome Paul Philpott, and Donna Jane Philpott (Santrock). Said Harriet Philpott died testate on September 16, 2023 in Kanawha County, West Virginia and devised the subject property to Joseph Stanley Philpott, Jr., Virginia Lynn Philpott, John Oscar Philpott, Jerome Paul Philpott, and Donna Jane Philpott (Santrock) by her Last Will and Testament and recorded in the aforesaid Clerk's office in Will Book 1013, at Page 887. Lot 21-22 all those certain lots or parcels of real estate, together with the buildings and improvements thereon, and the appurtenances thereunto belonging, situate, lying and being in St. Albans District, Kanawha County, West Virginia, more particularly bounded and described as follows: Lots Nos. 21 and 22 of Block "B" of Holley Boulevard Addition to St. Albans, Jefferson District, Kanawha County, West Virginia as shown on the map of said Addition, of record in the office of the Clerk of the County Court of Kanawha County, West Virginia. Reference is here made to the aforesaid map and deed for a more particular description of the property hereby conveyed. And being the same property conveyed to Joseph S. Philpott and Harriet Philpott, as joint tenants with right of survivorship, and not as tenants in common, from Porter Properties, Inc., by deed dated February 2, 1972 of record in said Clerk's office in Deed Book 1644, at page 205. The said Joseph S. Philpott died on June 18, 1990, and by virtue of manner in which title was held, Harriet Philpott became the owner of said property herein conveyed. AND BEING the same real estate conveyed to Harriet Lou Philpott Revocable Trust, dated January 17, 2023 (inadvertently referred to as "Phipott"), by Harriet L. Philpott, by her guardian and conservator, John Oscar Philpott, by deed dated February 16, 2023, which Deed is recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 3158, at Page 354. Lot 23-24 all those certain lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Saint Albans, Kanawha County, West Virginia, and being known, designated and described as all of Lots twenty-three (23) and twenty-four (24) of Block "B" of Holley Boulevards Addition to said city, as shown upon a map of said Addition, duly of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, and further as shown upon that certain map entitled "Map Showing Lots No. 23 and 24, Block "B", Holley Boulevards Addn., M. B. 11, P. 106, Owned: Margaret W. Shepherd, D.B. 1506 P. 531", made by Carl Kinder, Sr., LLS, dated July 12, 1979, which said map is attached hereto and a part hereof by reference. And being the same property conveyed unto Joseph S. Philpott, Sr. and Harriet L. Philpott, as joint tenants with right of survivorship, and not as tenants in common by Margaret W. Shepherd and Walton Shepherd, Sr., by deed dated August 1, 1979, and of record in the aforesaid Clerk's Office in Deed Book 1920, at page 138. The said Joseph Philpott died on June 18, 1990, and by virtue of manner in which title was held, Harriet Philpott became the owner of said property herein conveyed. Said Harriet Philpott died testate on September 16, 2023 in Kanawha County, West Virginia and devised the subject property to Joseph Stanely Philpott, Jr., Virginia Lynn Philpott, John Oscar Philpott, Jerome Paul Philpott, and Donna Jane Philpott (Santrock) by her Last Will and Testament and recorded in the aforesaid Clerk's office in Will Book 1013, at Page 887. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 409 Drew Street, St. Albans, WV 25177. AND BEING the same real estate which was conveyed to Eriq Valenzuela and Mackenzie Arbaugh, by Deed dated April 12, 2024, from John Oscar Philpott, trustee of the Harriet Lou Philpott Revocable Trust and Joseph Stanley Philpott, Jr., Virginia Lynn Philpott, John Oscar Philpott, Jerome Paul Philpott, and Donna Jane Philpott nka Donna Jane Santrock, as the devisees under the Last Will and Testament of Harriet Lou Philpott, and the sole heirs at law of Joseph S. Philpott, deceased, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 3196 at Page 801. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
